Legal action under discrimination legislation

If an individual has been discriminated against in the workplace he/she may be awarded compensation by an employment tribunal.

Compensation may include loss of earnings, an award for injury to feelings, and an order that such discrimination ceases. Awards are unlimited and can be very high.

It is essential to note that an employee may be barred from bringing a discrimination claim if the employee's grievance has not been set out in writing to their employer within a certain time period (3 months from the act of discrimination) or before issuing a claim in the Employment Tribunal.

It is essential that an employee bring a claim within the stipulated time limits (often just 3 months) from the act of discrimination.

It is therefore imperative that employees take full legal advice in relation to legal proceedings.
